Prohibited Items Policy

What may not be listed or sold on EstateSail, what requires special licensing, and how to report a listing that violates this policy.

Some items may not be listed or sold on EstateSail because they are illegal, unsafe, restricted, or carry licensing requirements that the marketplace cannot reliably verify.

Sellers are responsible for ensuring that everything they list complies with applicable law and with this policy. EstateSail may remove listings, cancel orders, suspend accounts, or report activity to authorities at any time.

Prohibited Items

The following items are prohibited on EstateSail and may not be listed or sold through the marketplace, regardless of whether the seller holds a license elsewhere:

  • Firearms, firearm frames or receivers, suppressors, and other regulated firearm components
  • Ammunition, primers, and gunpowder
  • Explosives, fireworks, flares, and pyrotechnics
  • Alcoholic beverages
  • Tobacco, vape, and other nicotine products
  • Prescription drugs and prescription-only medical devices
  • Illegal drugs, controlled substances, and drug paraphernalia
  • Recalled products as listed on the official CPSC, NHTSA, FDA, or USDA recall lists
  • Counterfeit or unauthorized replicas of branded goods
  • Stolen goods or goods of suspected unlawful origin
  • Hazardous chemicals, pesticides, herbicides, fungicides, and poisons
  • Asbestos, lead-based paint, mercury devices, and other hazardous materials
  • Items containing ivory, rhino horn, sea-turtle shell, or other CITES-listed wildlife products
  • Migratory bird parts, eagle feathers, and other Migratory Bird Treaty Act items
  • Human remains, human body parts, and most human tissues
  • Live animals
  • Items that require an export license or that violate applicable export, sanctions, or embargo laws
  • Items that violate consumer protection, labeling, or product-safety laws
  • Items that infringe a third party's trademark, copyright, patent, or right of publicity

Restricted (License Required)

The following items may be allowed in narrow circumstances, but only when (a) the seller holds every license required by federal, state, and local law, (b) EstateSail expressly allows the listing for that seller in writing, and (c) every applicable rule from the carrier, payment processor, and the law of the buyer's and seller's states is satisfied. By default, listings in these categories are not allowed:

  • Antique firearms or firearm parts that meet the federal antique definition (sellers must comply with all FFL, ATF, and state rules where applicable)
  • Knives, swords, and edged weapons subject to state restrictions
  • Antique medical, dental, scientific, taxidermy, or pharmacy items
  • Items containing controlled refrigerants, lead, mercury, or other regulated substances
  • Self-defense items (pepper spray, stun devices) where state law restricts sale or possession
  • Vehicles, vehicle parts, watercraft, aircraft, and trailers (require title transfer; pickup logistics are seller's responsibility)

Estate-Specific Items That Are Generally Allowed

Most items typically found at estate sales (furniture, decor, art, collectibles, china, glassware, clothing, books, jewelry, garden items, kitchenware, tools, and so on) are allowed, provided they do not fall into the prohibited or restricted categories above and they comply with applicable law and the Marketplace Terms.

Reporting and Enforcement

If you see a listing that violates this policy, please report it to support@estatesail.us with the sale URL, the item URL or itemId, and a brief description of the issue.

EstateSail may, in its sole discretion and without notice, remove listings, cancel orders, hold or reverse payouts, suspend or terminate accounts, decline to issue refunds for prohibited items, and report activity to law enforcement, customs, or other authorities if we reasonably believe an item or transaction violates this policy or applicable law.
