Privacy Policy
This policy explains what information EstateSail collects from shoppers, how we use it, when it may be shared with sellers and service providers, and the privacy choices and rights available to you.

EstateSail collects information needed to operate the marketplace, process orders, coordinate pickup and shipping, prevent fraud, provide support, improve the Service, and send transactional messages.
We do not store full payment card numbers. Payment details are handled by payment processors such as Stripe or Square. Visit Privacy Choices to opt out of cross-context advertising sharing or submit a privacy request.
Overview
This Privacy Policy describes how EstateSail, LLC, a California limited liability company ("EstateSail," "Company," "we," "our," or "us"), collects, uses, discloses, and protects information when you ("you" or "your") visit our website, use our mobile applications, browse the marketplace, create an account, follow sales, place bids, buy items, receive messages, or contact support (the "Service"). By using the Service, you agree to the practices described in this Privacy Policy. If you do not agree, please stop using the Service.
The Service may include links to, or integrate with, third-party websites, applications, and services (such as payment processors, shipping carriers, mapping providers, and Sellers' own websites). Those third parties have their own privacy practices, which this Privacy Policy does not cover.
Information We Collect
Identifiers and Contact Information You Provide. When you create an account, sign in, save preferences, follow a sale, place a bid, add items to a cart, or check out, you may provide information such as your name, email address, phone number, postal address, shipping address, password, and profile photo. The Service may also support messages between users, which we may store and process.
Transaction and Payment Information. When you make a purchase, we and our payment processors collect order, payment, and shipping information, including billing address, shipping address, transaction amounts, payment status, refund history, item information, and limited card metadata such as the last four digits, brand, and expiration. EstateSail does not store full payment card numbers; full card details are handled by our payment processors.
Marketplace Activity. We collect information about how you interact with the marketplace, including sales viewed, items viewed, watchlist activity, cart activity, checkout attempts, completed orders, bids, follows, fulfillment status, search terms, and customer-support interactions.
Internet, Device, and Network Activity. When you use the Service, we automatically collect information made available by your browser, device, and internet service provider, including IP address, device identifiers, operating system, browser type, language, referral URL, time zone, screen size, pages and items viewed, dates and times of access, and crash and performance data.
Geolocation Information. We may collect approximate location from your IP address or zip code. With your permission, we may collect more precise device location to show nearby sales or to support pickup features.
Public Content. If you submit reviews, comments, photos, or other content that is visible to others, that content may be stored, displayed, copied, shared, or used by third parties even after you remove it. Consider carefully what personal information you include.
Social and Single Sign-On Data. If you choose to sign in or connect a social or third-party account, we receive the information that platform shares (such as your name, email address, profile picture, or account ID) under that platform's permissions and policies.
Communications and Support. When you contact support or correspond with us, we collect the contents of those communications, your contact details, and any attachments or order references you provide.
Other Information. We may collect other information you choose to provide, such as feedback, survey responses, or marketing preferences.
How We Collect Information
Directly from You. We collect information you provide when you register, sign in, save preferences, place an order or bid, fill out a form, or contact support.
Automatically. We collect information automatically through cookies, local storage, web beacons, pixels, mobile SDKs, and similar technologies when you use the Service.
From Sellers and Other Users. Sellers may share order and contact information with us so we can complete transactions and fulfillment. Users who interact with you on the Service may also provide information about you.
From Service Providers and Partners. We receive information from payment processors, shipping carriers, identity and fraud-prevention providers, analytics and advertising partners, hosting providers, and other vendors that help us operate the Service.
From Public Sources. We may collect information from publicly available sources, such as business registries, where lawful.
Cookies and Similar Technologies
EstateSail and our service providers use cookies, local storage, session storage, and similar technologies to keep you signed in, remember carts and preferences (such as dark mode), measure marketplace performance, secure your account, prevent fraud, and analyze how the Service is used.
Some cookies are essential to operate the Service (for example, session, authentication, cart, checkout, and security cookies). Disabling these cookies may break account, cart, checkout, and preference features.
We may also use analytics and advertising cookies, web beacons, and pixels — including those provided by third parties — to understand how the Service is used and, where applicable, to deliver advertising. These technologies may collect device identifiers, IP address, pages viewed, items viewed, referral information, and similar usage data.
You can manage cookies through your browser settings, opt out of certain advertising cookies through industry tools (such as the Network Advertising Initiative at networkadvertising.org/choices, the Digital Advertising Alliance at aboutads.info/choices, or YourAdChoices), and adjust mobile advertising identifiers in your device settings.
How We Use Information
Operating the Service. To create and authenticate accounts, sync carts, list and display sales and items, process bids and orders, send receipts and order updates, coordinate pickup and shipping, manage refunds, and provide customer support.
Improving the Service. To analyze usage, monitor performance, debug issues, develop new features, and improve the user experience.
Security and Fraud Prevention. To detect, investigate, and prevent fraudulent transactions, abuse, security incidents, and unauthorized access, and to enforce our Terms of Service and other policies.
Communications. To send transactional messages (account confirmations, receipts, order updates, cart and bid reminders, refund notifications, and policy updates), respond to inquiries, and where permitted send marketing or promotional messages with opt-out options.
Legal and Compliance. To comply with applicable laws, regulations, court orders, and lawful requests, and to establish, exercise, or defend legal claims.
Aggregate and De-Identified Data. We may create de-identified or aggregated data that cannot reasonably be used to identify you and use it for any lawful purpose, including product analytics, research, marketing, and benchmarking.
How We Share Information
With Sellers. We share order, contact, and fulfillment information with the Seller responsible for a sale so they can prepare items, communicate with you, ship orders, coordinate pickup, issue refunds, and provide customer service.
With Service Providers. We share information with vendors that help us run EstateSail, including hosting, database, storage, authentication, payment processing, fraud prevention, shipping, email and SMS delivery, analytics, error monitoring, customer support, and infrastructure providers. These providers may use your information only to perform services for us under appropriate confidentiality and security obligations.
For Legal Reasons. We may disclose information when we believe in good faith that disclosure is required by law, regulation, court order, subpoena, or other legal process; to enforce our Terms of Service; to protect EstateSail, users, Sellers, the public, or our rights, property, or safety; or to investigate suspected fraud or abuse.
Business Transfers. If EstateSail is involved in a merger, acquisition, financing, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction, subject to standard confidentiality protections and applicable law.
With Your Consent. We may share information for other purposes with your consent or at your direction.
Public Content. Reviews, ratings, and similar content you submit may be visible to other users and the public.
Sale of Personal Information
EstateSail does not sell personal information for monetary consideration. Some uses of cookies and analytics tools may be considered "sharing" or "selling" under certain laws (such as for cross-context behavioral advertising). If we engage in such practices, you can opt out using the methods described in the Cookies and Similar Technologies section, by using your browser's privacy controls (including Global Privacy Control signals, where supported), or by contacting us at support@estatesail.us.
SMS and Text Messaging
When you provide your phone number during estate sale check-in or at checkout, we may use it to send you transactional SMS messages related to your check-in status or purchase receipt. If you separately opt in to promotional messaging, we may also send you notifications about upcoming estate sales. Consent to promotional messages is not a condition of any purchase.
We will never sell, rent, or share your phone number or SMS opt-in data with third parties for their own marketing purposes. Your phone number is used solely by EstateSail and our messaging service providers to deliver the messages described above and in our SMS/Text Messaging Terms.
You may opt out of SMS messages at any time by replying STOP to any message. For help, reply HELP or contact support@estatesail.us. Message and data rates may apply.
Data Security
We use reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. These include access controls, encryption in transit, secure infrastructure providers, and monitoring.
No online service can guarantee absolute security. You are responsible for keeping your account credentials confidential, using a strong unique password, and notifying us immediately at support@estatesail.us if you suspect unauthorized access to your account.
Data Retention
We keep personal information for as long as needed to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, prevent fraud, and enforce our agreements. Order, receipt, refund, accounting, and tax records may be retained for longer periods where required for legal, accounting, or fraud-prevention purposes. When information is no longer needed, we delete or de-identify it.
International Data Transfers
EstateSail is based in the United States, and our service providers may operate in the United States and other countries. By using the Service, you understand that your information will be processed in the United States, which may have data-protection laws different from those in your country. Where required, we use appropriate safeguards to protect personal information transferred across borders.
Your Privacy Choices and Rights
Account Information. You can review and update most account information through your account settings or by contacting support@estatesail.us.
Marketing Communications. You may unsubscribe from marketing emails by following the unsubscribe link in those messages. You will continue to receive non-promotional, transactional messages necessary to provide the Service.
Cookies and Tracking. You can manage cookies through your browser settings and opt out of certain advertising cookies as described in the Cookies and Similar Technologies section.
Privacy Requests. Subject to applicable law, you may have the right to request access to, correction of, deletion of, portability of, or restriction on processing of personal information we hold about you, and to withdraw consent where processing is based on consent. To submit a request, contact support@estatesail.us with the email or phone number associated with your account and a description of your request.
Identity Verification. To protect your privacy, we may take reasonable steps to verify your identity before fulfilling a privacy request. We may also verify the identity of any authorized agent who submits a request on your behalf.
No Discrimination. We will not discriminate against you for exercising your privacy rights.
California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), gives you the following rights, subject to verification and exceptions: (a) the right to know the categories and specific pieces of personal information we collect, the categories of sources, the business or commercial purposes, and the categories of third parties with whom we share or disclose information; (b) the right to request correction of inaccurate personal information; (c) the right to request deletion of personal information we have collected; (d) the right to opt out of the sale or sharing of personal information for cross-context behavioral advertising; (e) the right to limit the use and disclosure of sensitive personal information; and (f) the right not to receive discriminatory treatment for exercising your rights.

Under California's "Shine the Light" law, California residents may request information about disclosures of personal information to third parties for those parties' direct marketing purposes; we generally do not share personal information with third parties for their own direct marketing.
Other U.S. State Residents
If you are a resident of a U.S. state with a comprehensive privacy law (such as Colorado, Connecticut, Virginia, Utah, Texas, Oregon, or Montana, among others), you may have similar rights to access, correct, delete, port, or limit certain processing of your personal information, and to opt out of targeted advertising or "sales" of personal information. To exercise these rights, contact us at support@estatesail.us. You may also have the right to appeal a decision we make about a privacy request; appeal instructions will be provided in our response.
European Economic Area, United Kingdom, and Switzerland Residents
If you are located in the European Economic Area, the United Kingdom, or Switzerland, you may have rights under the GDPR or similar laws to access, correct, update, or erase your personal information; to object to or restrict certain processing; to data portability; and to withdraw consent where processing is based on consent. You may also have the right to lodge a complaint with your local data-protection authority.
We process personal information on the following legal bases: performance of a contract with you (for example, processing orders); compliance with legal obligations (for example, tax and recordkeeping); our legitimate interests (for example, securing and improving the Service, preventing fraud, and operating our business), provided those interests are not overridden by your rights; and your consent, where required.
Children's Privacy
EstateSail is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it. If you believe a child has provided us with personal information, contact support@estatesail.us.
Do Not Track
Some browsers offer a "Do Not Track" ("DNT") signal. Because there is no consistent industry standard for responding to DNT signals, we currently do not respond to them. We continue to honor opt-outs for advertising cookies as described above and, where supported by your browser, the Global Privacy Control signal as a request to opt out of the sale or sharing of personal information.
Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page indicates when it was most recently revised. Material changes will be posted here and, where appropriate, communicated to you by other means. Your continued use of the Service after the effective date of an updated policy constitutes acceptance of the changes.
